Former cellmate talks of time with Dokich

The following is an former inmates account of what Dokich was doing to him in prison. This former inmate has contacted me, your fearless blogger, and I have changed his name to John Doe.

Keep in mind these are hard copy documents and I have to run them through a program to convert them to text. It's not a perfect process and there may be typos I do not catch.

Warning, there is some graphic content.

There was a telephone interview by Senior Investigator Todd Loveless, Riverside County District Attorney Bureau of Investigation, dated 03-11-05. The subject was John Doe, who had been a cellmate of Mr. Dokich. The following is a synopsis of that interview; spelling and punctuation have been regularized:

John Doe was a cellmate of David Dokich during a period of time when both were incarcerated at Soledad State Prison, California. John Doe was incarcerated at Soledad from October 1995 to July 1996. John Doe was housed at Whitney Hall at Soledad when an inmate (unknown by name to John Doe) approached John Doe and asked him if he wanted to be Dokich's cellmate. Even though John Doe had never met Dokich, John Doe agreed to become Dokich's cellmate. Looking back, John Doe believes Dokich had been watching him for a period of time, considering him as a potential cellmate, knowing that Dokich's current cellmate was soon to be released.

After John Doe moved in with Dokich, "everything was good for about a couple of days or so." John Doe described Dokich as "quiet and liked to draw." Initially, Dokich even cooked for John Doe and drew pictures for him. Soon Dokich's behavior changed toward John Doe. Dokich began pressuring John Doe into engaging in sex acts with him. In retrospect, John Doe felt Dokich expected to receive sexual favors from him in return for Dokich's acts of kindness.

John Doe went on to explain that typically at night, after lights were out, Dokich tried to fondle John Doe's genitals and wanted John Doe to fondle him. John Doe stated that he (John Doe) tried to "divert it (Dokich's advances) as much as possible". John Doe stated that the sex acts escalated "very fast" eventually occurring daily and sometimes twice a day. John Doe described Dokich as being "determined to get what he wanted." On one occasion, Dokich told John Doe to grab hold of the bars of their cell and keep a lookout for the guards. Dokich then pulled John Doe's pants down and placed his erect penis between John Doe's legs, simulating sodomy upon John Doe. John Doe stated that Dokich feared John Doe was going to "rat on him" for the sex acts and told John Doe, "I'll come looking for you" (upon Dokich'S release from prison) if John Doe told anyone.

About a month later, not knowing what to do about the situation and fearing Dokich eventually would become violent and rape him, John Doe "shot a kite" (hand-written message) to the "main Correctional Officer." In the note John Doe stated Dokich was a "pervert" and demanded, "Get me out of here." As a temporary solution, John Doe was offered solitary confinement. John Doe readily accepted the offer, stating, "The guy (Dokich) had back-up,you know, power. . . he has charisma. . ." John Doe went on to say, "I was just trying to lay low to do my time. . . and didn't want to be caught up in anything." Later the same day that John Doe informed Soledad officials about what was happening to him at the hands of Dokich, an "adverse transfer" was arranged for Dokich, relocating him to another section of the prison.

John Doe went on to say he was "really afraid" of Dokich, because Dokich had been "down for a while and knew a lot of people on our yard" some of whom were associated with the Nazi Lowriders, the Bruisers, Aryan Brotherhood, and "shotcallers . . . from the main white guys." John Doe was concerned Dokich would use his influence to have someone stab John Doe. John Doe stated that Dokich being 10 to 12 years older than he and being very muscular also [contributed] to John Doe's fear of Dokich.

During John Doe's approximate six-week stay in the same cell with Dokich, Dokich was a "control freak" and "violent." John Doe explained that Dokich acted ". . . like he was a husband and his wife came home," easily losing his temper over minor things such as the cell being dirty. John Doe further compared Dokich losing his temper to the way "a mean father does to his child." Overall, John Doe stated Dokich treated him like he was Dokich's "bitch," [and Dokich] tried to control, manipulate, and intimidate him. Typically, Dokich would fondle John Doe while they were watching T.V. at night. Dokich would also take John Doe's hand and put it on Dokich's genitals, wanting John Doe to fondle him. To avoid Dokich, John Doe stayed out in the exercise yard as long as possible. However, there were occasions when Dokich would send another inmate to contact John Doe, telling him that Dokich wanted him back at the cell.

John Doe explained that due to Dokich's "pull" with many of the prison guards, John Doe received extra privileges. In return, Dokich assumed he (Dokich) could take "advantage" of John Doe sexually. John Doe stated that Dokich never assaulted or physically abused him, but Dokich orally copulated him on two or three occasions. Had Dokich not been transferred, John Doe believed Dokich eventually would have manipulated or intimidated John Doe into orally copulating him. John Doe confided to some of his close friends/fellow inmates at Soledad as to what Dokich was doing to him. Some of those subjects offered to assault Dokich on John Doe's behalf. To this day, John Doe fears that Dokich will come looking for him, based upon Dokich's past threats while Dokich and John Doe were cellmates, "because it was so powerful the way the guy was."

This report was known prior to the release of Dokich in 2005 and they still let him out on parole. Yep, this is the type of guy they want to house in a home near you.

David Allyn Dokich declared a psychopath

Ah, the joys of wading through court records. I will attempt to spare boring you to death by posting some of the more interesting highlights.

Below is part of one of the evaluators findings:

The evaluator rated him on the Hare Psychopathy Checklist Revised (PCL-R) . This checklist instrument measures psychopathic personality traits. On the PCL-R, Mr. Dokich received a total score of 34 out of 40.

Two primary factors contribute to the PCL-R.

On factor one, which measures a selfish, remorseless, and exploitative use of others, Mr. Dokich scored at the 100th percentile when compared with other male prison inmates. In other words, he exhibits these traits at a greater level than approximately 100 percent of other prisoners.

On factor two, which measures a chronically unstable and antisocial lifestyle, the traits typically associated with antisocial personality disorder, he scored at the 68th percentile when compared with other male prison inmates.

The overall PCL-R placed Mr. Dokich as being more psychopathic than 96 percent of prison inmates. Individuals with high PCL-R scores are found to have a very poor prognosis and tend to remain aggressive over the course of their life, as opposed to many other individuals who commit violent acts but whose propensity for violence decreases with age.

Keep in mind they are not comparing Dokich to boys scouts and little old ladies, they are comparing him to other prison inmates, the worst society has to offer.

This time around, both shrinks agree, Dokich is a SVP

When an inmate with a history of sex offenses is about to be released from prison, the DA has the option to petition the court and ask that the inmate be committed to Atascadero State Hospital as a sexually violent predator.

One part of this process is to have the inmate evaluated by two psychologists. If they both agree that the inmate meets the criteria as a sexually violent predator then next step is usually a court hearing. However, if they disagree and one thinks the inmate is not a sexually violent predator they are released on parole. Yep, a tight goes to the sex offender.

This is what happened prior to the release of David Allyn Dokich in May of 2005.

However this time things are different for the twice convicted sex offender. Court records show that both shrinks agree Dokich meets the criteria for a sexually violent predator.

The next step is on 2/15/2007 when the court will hear the petition to send Dokich to Atascadero.

Bogh bill protects victims of sex crimes

Bill Sponsored by Riverside County District Attorney Passes Assembly

Sacramento - Assembly Bill 1996 by Assembly Republican Caucus Chair Russ Bogh (R-Beaumont) was passed by the State Assembly today on a bi-partisan basis. AB 1996 is a follow-up to Bogh's AB 2829, a rape shield bill which was signed into law in 2004.

Assembly Bill 1996 will expand current protections against using the previous sexual conduct of a victim of sexual assault or abuse to discredit their testimony by making it public even when such information is not admissible as evidence in court. This bill will extend much needed privacy protection to prior abuse victims who come forward to testify in subsequent crimes.

"Too often I've seen attempts to put victims and witnesses on trial in a devious effort to somehow justify the actions of their attackers," commented Rod Pacheco, Riverside County Chief Deputy District Attorney. "This bill will ensure that such dishonest attempts never see the light of day."

Assembly Bill 1996 will ensure that when the sexual history of current or previous victims testifying in court is offered as evidence it be filed with the court under seal, and not made public, unless and until the court determines that such evidence is admissible in court. Current law protects the victim of the current offense, but does not apply to previous victims of the defendant who testify in the current court case.

"Victims of sex crimes are often victimized again when unscrupulous defense attorneys seek to intimidate and publicly humiliate victims and witnesses," said Bogh. "AB 1996 is an important step that must be taken to protect the privacy of victims from these unwarranted attacks."

Assemblyman Bogh represents the 65th Assembly District, which includes portions of Riverside and San Bernardino counties.

Ontario halfway house shut down

Remember Arthur Dean? He had a sex offender clown house for child molester right in the middle of a quiet street in Ontario, a street with many children. David Goldstein did a story on him last November. Click here to read it and watch the video.

Well reports are it is closed. Parole took all the parolees and shuffled them somewhere else.

"I'm fed up with it," Dean said. "It's not worth my time and effort to be stepped on."

Maybe Dean can try to earn a living without putting children at risk.

Violaters Face Fine, Jail Time

Sex offenders convicted of crimes against children will be prohibited from living within 500 feet of schools and parks in Chula Vista under an ordinance unanimously approved by the City Council.

Violators of the law, approved late Tuesday night, will be subject to a fine of up to $1,000 and/or six months in jail, according to Liz Pursell, director of communications for the city of Chula Vista.

Violent Sex Offender On The Loose

SAN DIEGO -- A violent criminal is on the loose in San Diego, according to police.

The Department of Justice said that Dartanian Hill has a history of violent crimes, including sexual assaults on children under 14. According to investigators, Hill is supposed to register every 30 days but has failed to do so since September.

Hill is known to spend time in North County. Anyone with information about Hill's whereabouts is being urged to call police.

South Carolina Senate approves death penalty for child molesters

The South Carolina Senate has given preliminary approval to a bill that authorizes the death penalty for twice-convicted child molesters.
The proposal approved yesterday still needs a final reading before going on to the House.

It would authorize prosecutors to seek capital punishment for any sex offender convicted twice of raping children younger than eleven.

Candidate pushes for 'predator free' zones

Banning Councilwoman Brenda Salas pushed Tuesday for "predator-free" zones of more than a third of a mile around parks, bus stops and schools.

Salas, a Republican seeking California's 65th District Assembly seat, lobbied at the City Council meeting to get Banning prepared for Jessica's Law -- a November ballot measure aimed at keeping registered sex offenders away from children.

This time in Darke County, Ohio. The sting occured March 25, 26 and 27.

Sheriff Deputies arrested 17 men as they left the sting house, including another teacher.

James M. Rutherford of Mainville, Ohio, was a 6th grade teacher at the St. Margaret of York School in Deerfield Township. The Archdiocese of Cincinnati says he has been suspended.

License of Osteopathic Pediatrician Suspended

State Board action stems from nationally-televised online teen sex-chat sting

SAN DIEGO – The Osteopathic Medical Board of California today obtained an Interim Suspension Order (ISO) against osteopathic pediatrician Jeffrey R. Beck for alleged unprofessional conducted related to a news media "sting" in which he thought he was engaging in sexually explicit online chats with a teenaged boy, and even arranged to meet the individual he thought was a teenager.

The ISO was approved by a judge in the Office of Administrative Hearings and bars Beck, of Ramona, Calif., from practicing while the Board moves forward with a formal accusation of misconduct that could result in permanent revocation of Beck's license.

Beck was featured in an MSNBC Dateline segment last year in which he agreed to meet a supposed 14-year-old boy, "Luke," with whom he had corresponded in online chat rooms. "Luke" was actually a trained volunteer working for child-protection organization "Perverted Justice." When Beck, then of Maryland, showed up at what he thought was "Luke's" house in suburban Washington, D.C., last August, he was instead confronted by television cameras and a reporter.

The Board stated in its Accusation that the evidence establishes that the doctor's "conduct is of such a nature that it has the capacity to cause substantial harm and injury to his patients." The Accusation states Beck "is all the more dangerous because he practices pediatric medicine" and "is in contact with the very patient population he previously tried to solicit for sex. Nothing could be more dangerous."

Beck, who moved from Maryland to California after the media exposure, was first licensed by the California Osteopathic Medical Board in 1979, but his license had been inactive for some time prior to December 28, 2005, when his request to reactivate the license was approved. Maryland authorities could not prosecute Beck criminally because that state's laws require a police officer to take part in such online chat room sting investigations. Calls from Maryland authorities alerted the California Board to the alleged unprofessional conduct and the Board launched an investigation on January 6.

ROSARITO BEACH – Some of the retired U.S. citizens who live here thought there was something a little odd about the stranger who started showing up at their English-language church services about a year ago.

He occasionally led a Bible-study prayer session, but Richard Alan Rearley, 45, didn't really explain why he was living and working among the seniors. Some retirees were so concerned that they started looking into Rearley's past and discovered he was a convicted sex offender in the United States with an outstanding arrest warrant.

A cross-border investigation based on the retirees' tip to U.S. authorities led to Rearley's arrest March 5 as he left a Rosarito Beach church with a Bible in his hand. Rearley, a longtime East County resident who went by the last name Alan in Mexico, was turned over to U.S. authorities. He's in custody on two counts of failure to register as a sex offender.

Hottie Pedophiles Deserve Prison Time, Too

OK, so maybe it was the in-the-flesh realization of almost every young guy’s steamiest dream. But schoolteacher-blonde bombshell Debra Lafave’s sexual relationship with a 14-year-old student was illegal, amoral and it deserves realistic punishment — not the hall pass she received this week when Florida state prosecutors dropped the charges she’d pleaded guilty to.

Those accusations? Having sex with the boy in the back of her sport utility vehicle, while his cousin served as chauffeur.

Oh, I know. The 25-year-old better-than-Heather-Locklear-in-her-best-years look-alike didn’t completely get off scot-free. She still has three years of house arrest to finish and seven years of probation for having sex with him in her classroom and home — the same abode she was sharing at the time with her then-husband of only 11 months.

Between her recent diagnosis of bipolar disorder — used effectively by the defense to “explain” Lafave’s hypersexual state — as well as the boy’s family not letting him testify so as to spare him more anxiety and stress, the case fizzled.

(Why couldn’t he have given taped testimony? Why couldn’t his cousin have been used as a witness? Surely, there was plenty of corroborating evidence.)

So much for the 15 years in prison and $10,000 fine she might have received. I guess those punishments are reserved for the real pedophiles in our society — menfolk and ugly women.

Warrant discovered after suspect leaves

DOUBLE TROUBLE: Hemet police arrest a suspected sex offender, then must re-arrest him later.

A man arrested in Hemet on suspicion of exposing himself to school-age girls in a truck equipped with a police siren and lights was re-arrested late Thursday in Rialto.

The Rialto arrest stemmed from a warrant for Hector Gonzalez, a 22-year-old Bloomington resident, who was suspected of committing a similar offense in Fontana, Hemet police said Friday.

Gonzalez was taken into custody at his home by Rialto police on suspicion of offenses including child molestation, annoying children and exposing himself, Hemet police Cpl. James Waters said. Rialto police officials could not be reached Friday.

Does Public Safety Depend On Political Pressure?

It is an unfortunate fact that, it takes a heinous act of violence against a child for a bill substantially increasing criminal penalties to make it through the Public Safety committees of the California State Legislature. Even then, it may take the outrage and undying persistence of a parent who has lost a child through this senseless, violent act to get a law passed.

Several times, even the heart-rending stories these parents tell cannot convince those in the majority party who control these committees, and often put the rights of criminals ahead of innocent victims, to pass laws to protect California’s children. These legislators still vote against bills that would take child predators off the streets. In some cases the parents of these children must appeal directly to California voters for tough new laws to end these tragedies.

Think about it. It took an initiative or a widely-reported senseless act to create the Three Strikes Law, Megan’s Law, and the Amber Alert system. They were all born of measures enacted only after innocent children were assaulted and, in some cases, killed, and only after parents amassed incredible pressure from the public and the media to force change, and the votes, in the California Legislature.

In 2004, liberal lawmakers gave in to massive pressure from parents, media, and law enforcement officials to provide “some” Internet access to data collected on California’s more than 100,000 registered sexual offenders. However, even that bill failed to include access to all of the key information about the risk those predators pose.

At the same time, those in the majority party controlling those committees rejected legislation that would have required these criminals to wear monitoring devices and ban them from living near or hanging out at parks or schools. In fact, in the last dozen years, the most liberal members controlling these committees have killed no fewer than 20 bills that would have increased penalties against sexual offenders or provided increased monitoring of their whereabouts by law enforcement officials.

It has happened again. Now that Jessica’s Law supporters gathered enough signatures to qualify the measure for the Noembmer ballot majority leadership has finally decided to get tough – in their own way.

Recently, they amended a bill, which originally would have weakened the Three Strikes Law, and created their own sex offender management bill. Let’s not forget that during this legislative session, these same members killed several bills that increase penalties for creating or trafficking child pornography, required child molesters to wear GPS tracking devices so police can monitor their movements, and prohibited Internet luring. In fact, up until they approved their watered-down version of Jessica’s Law, the only major piece of legislation the Assembly Public Safety Committee had passed was a moratorium on the death penalty.

So, California voters must ask – Is the watered down Jessica’s Law proposal enough? It may be a start, but it is nowhere close to being what the public expects, and it still does not stop sexual predators. For example, last month Dateline NBC aired an investigation where investigators or reporters posed as twelve- and thirteen-year-olds on the Internet in a sting in Riverside County that netted more than 50 arrests. Once online, adult men immediately began contacting these “kids,” attempting to lure them for sex.

Many of the suspects sent naked pictures, went into graphic detail about sexual activity, and arranged for meetings. In a three-day period, more than 50 suspects e-mailed, phoned, or instant messaged the decoys and then stopped by the house where they believed a teenage boy or girl was home alone. The suspects brought liquor, condoms, and pornography to their encounters. Thankfully, these folks will be facing felony charges for attempting to sexually assault a child due in large part to Dateline and the Riverside County Sheriff’s office.

However, most people who use the Internet to lure children in an attempt to molest them do not face felony prosecution because, under current law, a prosecutor must prove intent, and to do so, the sex predator has to meet up with the child. The naked photos, the graphic language, phone calls, and even e-mails to arrange a meeting may not be enough to obtain a felony charge.

Republicans have offered bills to strengthen Internet luring laws, but they have failed to clear Public Safety committees. Unfortunately, the current proposal does not go far enough when it comes to protecting kids from luring.

So, before the state has another victim, the Legislature must enact tougher penalties to safeguard the public, especially our children, from these and thousands of other sexual predators roaming our streets. If they don’t rest assured the provisions in Jessica’s Law that has the support of nearly 80 percent of those polled will offer those protections legislators haven’t.

Giving sex offenders another chance to prey on unsuspecting young victims threatens the safety of our families, a basic expectation of our society.

In San Bernardino County the 31st Senate District includes all of Big Bear, Grand Terrace, Highland, Loma Linda, Rancho Cucamonga, Redlands, Upland, Yucaipa, Yucca Valley, Crestline, Lake Arrowhead, Mentone, Running Springs, An Antonio Heights and portions of San Bernardino and Colton. In Riverside County the 31st Senate District includes all of Riverside, Glen Avon, Highgrove, Mira Loma, Pedley, Rubidoux, Sunnyslope and all but a small portion of Woodcrest.

Case continued for John Weaver

John Christopher Weaver is one of the perverts busted in the Dateline NBC / Perverted Justice / Riverside County Sheriff's Department sting operation in January.

Weaver was supposed to have a felony settlement conference today after having been charged with attempted child molestation.

However his attorney, Pete Scalisi, asked for and was granted a continuance.

Weaver remains free on bail.

Survivor keeps up fight to keep attacker in prison

SAN JOSE, Calif. — Michelle de la Calle typed in the name "Jerry Lunsford" on the Megan's Law Web site and watched as the face of the man who attacked her 15 years ago downloaded back into her life.

He was out of prison. He was living in San Jose.

She clicked on a map link. The map showed Lunsford was living three blocks away.

De la Calle fell down on her living room floor and sobbed. After a few minutes, she picked herself up, wiped her face and got out an old Manila folder labeled ``Rape Stuff.''

This morning, de la Calle will sit in a courtroom for a rare hearing in which a judge will reconsider Lunsford's sentence. She will once again confront the man convicted of choking her into unconsciousness and raping her in a San Jose garage when she was a teen.

Sentencing of sex predators

HORRIFYING stories about the rapes and murders of children, and about judges who go easy on sex offenders who prey on the young, have prompted some legislatures to tighten laws by restricting the judges' sentencing discretion.

Few in the media or among the intelligentsia have been as outraged about these sadistic crimes against children as they have about whether terrorists' phone calls have been intercepted.

Part of this is current politics but part is the continuation of a tradition that goes back more than two centuries, de-emphasizing the punishment of criminals.

People who today point to the flaws of "society" as the "root causes" of crime are echoing what was said in the 18th century by Condorcet in France and William Godwin in England, among others. So are those who speak loftily of "alternatives to incarceration" or who rely on hopes of "rehabilitation." Those with this mindset engage in much hand-wringing about what to do with sexual predators. While many ordinary people would say that they should be locked up -- and, if they are too dangerous to be at large, we should lock them up and throw away the key.

But those whose sense of themselves is based on their presumed superiority to ordinary people can never go along with that. They balk at notifying the public when a convicted sex predator is released to a neighborhood. Their thinking -- if it can be called that -- is that sex predators released from prison have "paid their debt to society" and so the slate should be wiped clean. It is amazing how many innocent lives have been sacrificed for a half- baked phrase.

Going to jail doesn't repay anything. People are put behind bars as punishment and to keep them out of circulation. Child victims of rape and murder cannot be made whole. The debt can never be repaid. The most we can hope for is to spare other children and their parents from the anguish inflicted by evil people -- not "sick" people, but evil people. Sex predators know exactly what they are doing, know that it is wrong, and either don't care or enjoy it all the more for that reason.

Megan's Law necessary evil

OF all the fascinating ways to blow time on the Web, nothing beats the state Justice Department Megan's Law site, the database of California's convicted sex offenders.

The site is both unconstitutional and fascinating, and I've spent countless hours checking to see whether any sex predators live near me, my girlfriend, my sister, my parents or my grandmother.

They do.

Represented on the site by blue dots on a map, they're all over the place. Hundreds, thousands of them. Right next to schools, churches, you name it.

Of course, all kinds of paroled criminals live near our homes and schools: drunken drivers, muggers, murderers, etc.

But if those people have been convicted and served their time, the general public cannot see their whole personal history at the click of a mouse. They've paid their debt to society, and they start over with a clean slate. The law says it's not our business to know if a paroled killer is buying the house next door. If he's served his time, it's a done deal.

This doesn't apply to sex offenders. Criminals of this kind never can pay their debt to society, and their offenses always will remain a matter of public record.

This is not fair, or constitutional. But nobody cares about that. Personally, I don't care about that. I use a double standard when judging these people, and I'm the first to admit it.

If and when I have children, a sex offender paroled or otherwise is a living, breathing menace, whereas the constitution is a nice piece of parchment tastefully framed in a museum.

Jury trial set for Alvin Hall

Alvin has pled not guilty to charges of attempted 288(a).

(a) Any person who willfully and lewdly commits any lewd or lascivious act, including any of the acts constituting other crimes provided for in Part 1, upon or with the body, or any part or member thereof, of a child who is under the age of 14 years, with the intent of arousing, appealing to, or gratifying the lust, passions, or sexual desires of that person or the child, is guilty of a felony and shall be punished by imprisonment in the state prison for three, six, or eight years.

His trial by jury has been set for April 24th, 2006.

School district settles suit in molestation case

FONTANA: The family of a former Kaiser High student will get $425,000, a news release said.

The Fontana Unified School District announced Wednesday that it has agreed to a $425,000 settlement with the family of a former Kaiser High School student who was molested by a teacher on campus in 2004.

No reason was given for the settlement in a 622-word news release issued by Maria Aarvig, the school district's attorney.

The parents sued in 2004 in the wake of their daughter's sexual relationship with Edward Young Kang, 34, a former Kaiser science teacher and girls volleyball coach. The lawsuit alleged negligent supervision of Kang and the family was seeking as much as $15 million during pretrial proceedings. The Press-Enterprise does not name the victims of sexual crimes.

Wednesday's news release did not mention whether Fontana Unified School District accepted any responsibility for supervising Kang, who was convicted in 2005 on four counts relating to having unlawful sex with two minors. Fontana Police have identified Kang as a sexual predator.

Chula Vista approves limits on sex offenders

CHULA VISTA – The City Council voted unanimously Tuesday night to prohibit convicted sex offenders from living within 500 feet of schools and parks.

The law applies to offenders who committed crimes against minors. Violators can be fined up to $1,000 or jailed for up to six months or both.

Similar laws were passed by National City, La Mesa and Santee in recent months.

The city's law supplements a state law, which prohibits convicted sex offenders on parole from living within a quarter-mile, or 1,320 feet, of a school. State law requires convicted sex offenders to register regularly with police every year and when they move.

The law does not apply to offenders who established a residence before July 1, 2006.

Remember all the perverts busted in the Dateline NBC / Perverted Justice / Riverside County Sheriff's Department sting operation in January?

Well those perverts were arrested. The bail amount for most of them was $50,000. Since they only have to put up 10%, that's just $5,000. Most were able to post that and were released.

The Laguna Beach Police Department had their own sting operation a month later with Perverted Justice. While they were conducting that online sting operation both Eddie Chan (aka Hoi Dick Chan) and Keith Allen Williams got online and started chatting with the Laguna decoy, according to Perverted Justice. This is after they were arrested just weeks earlier!

In the chat logs posted at Perverted Justice Eddie Chan seems to be of the opinion that he is going to prison so he may as well get as much under age action as he can.

Fortunately as I reported here, Chan's bail was severely increased and he was taken into custody after that incident.

As for Keith Williams, wasn't he the one who told Chris Hansen that he had seen a previous episode of 'To Catch a Predator'? Well that did not deter him and it looks like actually getting arrested did not deter him either.

Court records show that Keith Allen Williams is still out on bail. That may change if the DA's office asks for his bail to be increased during his next court hearing which is scheduled for 4/7.

How many of these perverts bailed out and went right back online looking for under age sex?

What will it take to get through their puny perverted brains that the age of consent in California is 18 and that we as a society will not tolerate this any longer?

Minnesota girl, 16, allegedly held captive, prostituted

ST. PAUL, Minn. — A convicted sex offender lured a 16-year-old girl from a St. Paul McDonald's restaurant to a house in the Frogtown neighborhood, where a woman kept the victim in a closet for weeks and forced her into prostitution, police said Tuesday.

Authorities charged Lamiea Ball, 34, of St. Paul with kidnapping and false imprisonment Monday. Meanwhile, Alphonso Mitchell, the 33-year-old sex offender who police say lured the girl, has been sent back to prison for violating the terms of his release.

Woman arrested on multiple counts of child molestation

On March 21, 2006, the Indio Sheriff's Station initiated a criminal investigation involving the sexual abuse of several male and female children, ranging in age from 12 to 14 years.

It was determined that all of the victims lived in close proximity to a female adult by the name of Erica Serrano, 26 years of age, who resides in 68-000 block of Polk St, in Thermal. The investigation revealed that during a one-year period, Serrano molested the victims, after enticing them into her residence.

Based on information supplied to investigators, a search warrant was served at Serrano's home, where she was subsequently arrested for multiple counts of child molestation. Serrano was later booked at the Indio Jail. Her bail was set at $500,000. The name of the victims will not be released because of their age.

'Molly' addresses the San Bernardino City Council

San Bernardino is planning on use GPS to track paroled gang members.

I want to thank in advance Mayor Pat Morris and the entire San Bernanrdino City Council for allowing me the opportunity to address them.

My name is "Molly" and I reside in the County of Riverside. I am one of the citizens of Mead Valley, who for over eight months, protested the inappropriate placement of High Risk Sex Offender and Child Rapist David Allyn Dokich .

I am not here today to address the council on the issue of sex offenders, specifically. However, I am here to address the issue of GPS ankle monitors on certain gang members who are residents of San Bernardino County.

On March 15. 2006, David Allyn Dokich was cited by the Press Enterprise as an example of how well GPS ankle monitors work. The article, written by Chris Richard, states:

"Authorities say the devices are effective. In January, Riverside County authorities used an anklet to track twice - convicted rapist David Allyn Dokich after he was paroled to Mead Valley, eventually sending him back to prison for violating the terms of his parole."

I regret to inform this city council that a GPS anklet was not used to track Dokich and send him back to prison.. In fact, neither the California Department of Corrections & Rehabilitation nor its Moreno Valley Paroles Department had anything to do with catching Dokich violating his terms of parole!

The Riverside Sheriff's Department is the agency who is solely responsible for the eventual return of David Allyn Dokich to prison. To be even more specific, it was the hard work and dedication of the Perris Sheriff's station's Violent Offenders Registration Team - other wise known as V.O.R.T., who spent over two months following Dokich, to Q - Bonkers Billiards and placed him under video surveylance. The evidence compiled by the V.O.R.T. team was then provided to the Moreno Valley Paroles Department, who then decided to violate Dokich.

Furthermore, when the Moreno Valley Paroles Department attempted to locate Dokich using his GPS anklet, they were unable to locate him. That's why Dokich was called on his cell phone to report to the Moreno Valley Paroles Department where he was placed into custody.

Because of our protests, the Riverside Sheriff's Office decided to #### follow Dokich. Our Perris V.O.R.T. team did not use Dokich's GPS anklet because local law enforcement does not have access to the GPS information when it comes to parolees. Only paroles has access to the GPS tracking information.

I know exactly how David Allyn Dokich was caught by the Riverside County Sheriff's V.O.R.T. team because Captain Guy Kestell, head of the Perris Sheriff's Station personally told me and several other citizens involved in the Dokich protest, exactly how they did it!

To continue, I respectfully ask Mayor Morris and the entire San Bernardino City Council the following question:

1. David Allyn Dokich was frequenting Q - Bonkers for over two months, so why didn't the Moreno Valley Paroles Department know he was there?

It just doesn't make sense that Dokich was outfitted with a GPS anklet but paroles didn't know where he was!

The California Department of Corrections & Rehabilitation has, in my opinion, deliberatly misled this County's government and its residents into believing that it was they who caught David Allyn Dokich by using the GPS anklet tracking method.

I believe in and support the use of GPS monitoring. However, the GPS monitoring of parolees - whether they are gang members or sex offenders - is only as good as those who are monitoring the technology.

Regardless of where you stand on the issue of monitoring gang parolees using GPS technology, I strongly urge Mayor Morris and all members of this city council to contact the Riverside Sheriff's Office - Perris Division and ask Capt. Guy Kestell, Lte. Michael O'Donnel, or Corp. Luis Scull from the V.O.R.T. team, to explain the truth about how David Allyn Dokich was caught violating his terms of parole. Again, GPS ankle monitoring did not play a role in sending David Allyn Dokich back to prison.

Bill introduced to require registered sex offenders to renew driver license annually

Assembly bill 1788 would require registered sex offenders to renew their drivers license every year.

According to the bill's author, Assemblywoman Rebecca Cohn, D-Campbell, California authorities do not know the current addresses of more than 17,000 sex offenders.

The odd thing is, an almost identical bill was killed last year by the assembly public safety committee. Senate bill 629, introduced by Senator Bob Dutton, R-Rancho Cucamonga, also required registered sex offenders to renew their drivers license every year.

The bill received strong support from the California District Attorneys Association, California Peace Officers Association, California Attorney General and San Bernardino County Sheriff, however a representative from the California Prisoners Union spoke out against the measure.

SB 629 was watered down to every 2 years, yet Mark Leno, Jackie Goldberg, Ira Ruskin and Loni Hancock, all Democrats, voted against it. Big surprise.

Let's see what kind of success Assemblywoman Cohn has with her version.

Parolees home goes, anger stays

POMONA - Larry Taylor was stunned when he realized a group of parolees had moved into a house near his own on Knoll Ridge Drive.

The emotions he felt were strong, he said.

"Anger, fury ... total disbelief that this could happen in a residential setting," Taylor said.

The feelings were much the same for the other 30 or so residents of the quiet street in the Phillips Ranch neighborhood of Pomona.

"These transitional homes, we just can't accept them in the community," Taylor said.

The home on Knoll Ridge Drive opened late last month and housed four men who residents later learned were parolees. Residents, who have organized themselves under the name Phillips Ranch Community Coalition, said the operation was closed down last week but neighbors were still worried about future use of the home.

Sex offender expert says stalking is a cycle of practicing and perfecting a technique on the streets

VICTORVILLE — For months now the Victor Valley has been the stalking grounds of a sick mind.

There have been numerous reports of one or more individuals attempting to snatch children off the street. The latest attempt was Friday afternoon in Hesperia. An 8-year-old told San Bernardino County Sheriff's Department deputies that after stepping off the school bus she was attacked by a 30-year-old Hispanic man with a shaved head.

The description is similar to the per petrator in several other attempted abductions in the town of Apple Valley, Adelanto and Hesperia.

On Friday the girl escaped, as have all the other children, but the fear is that sooner or later the schoolchild stalker may be successful.

"My fear is that if some kid gets in this guy's car she is never going to come back alive," said Greig Veeder, executive director of Teaching Humane Existence, a non-profit organization in Colorado devoted to implementing effective control of and treatments for sex offenders.

He has spent years trying to understand the minds of sex offenders — once even going so far as riding in the backseat of a repeat offender's car as he stalked women. T.H.E. was instrumental in recent updates to Colorado law that toughened penalties for sex crimes, which are now the basis of the proposed Jessica's Law here in California.

Veeder said the person stalking the streets of the Victor Valley is perhaps practicing, developing his technique. Leading a double life of child stalker and normal member of society, the offender — whoever he is or they are — is enjoying the thrill.

Advances in technology are changing the way child pornography is produced and traded, and law enforcement is changing to keep pace.

A few years ago, those who pursue child pornographers focused on Internet Web sites that offered access to thousands of images for a fee.

Now, investigators working undercover and using high-tech tools are pursuing people who find each other in online meeting areas and trade images directly using e-mail and file-sharing programs.

Investigators also have begun cataloging unique identifiers – akin to digital fingerprints – of the images of exploited children, making it easier and faster for them to find what they're looking for.

Across the country, authorities have noticed an increase in the production of child pornography.

In San Diego County over the last few years, child pornography investigations have targeted a priest, a pediatrician, a school counselor, teachers and police officers.

On March 9, authorities arrested Wayne Albert Bleyle, a respiratory therapist at Children's Hospital. He is accused of photographing himself molesting some of the most vulnerable patients he cared for and distributing the pictures over the Internet.

These arrests and investigations show an increased focus by investigators into child pornography rings.

“Investigators are now starting to see more home-grown or self-produced pornography,” said Julie Myers, assistant secretary for immigration and customs enforcement,in announcing a crackdown in Chicago last week.

Customs inspectors have been investigating child pornography for decades, dating to when pornography was mailed in brown paper wrapping.

Some pictures crop up so frequently that they are referred to as “classic series.”

Several years ago, 85 percent of the images that investigators came across were of children they had already identified, Myers said.

But now, investigators who look through hard drives, digital cameras and digital music players are seeing children they don't recognize.

“We're seeing more new material and more new victims,” Myers said.

Look what the City of Santee did on its very own

Santee is down in the San Diego area for those of you who are geographically challenged.

The City of Santee has identified a problem:

WHEREAS, registered sex offenders pose a clear threat to children residing in or visiting Santee; and
WHEREAS, individuals who are required by law to register as sex offenders with any governmental entity have been convicted of serious sexual offenses; and
WHEREAS, registered sex offenders are more likely than any other type of offender to reoffend; and
WHEREAS, the City of Santee desires to impose safety precautions in furtherance of the compelling goal of protecting our children from sexual assault or other harm by sex offenders; and
WHEREAS, the City of Santee desires to add local restrictions where state law regulating sex offenders is silent by prohibiting sex offenders from loitering in areas that are primarily designed for use by, or are primarily used by, children.

The above is the first part of ordinance no. 454. It states "Any sex offender is prohibited from loitering on or within three hundred feet (300’) of a public or private school for children, a child care and development facility, a park or recreation facility, playground, or arcade."

Violators are subject to arrest, up to a $1,000 fine and/or 6 months in the county jail.

The City of Santee is not waiting around for the State of California to protect it's children.

Suspected molester added to Most Wanted list

SAN DIEGO – A fugitive suspected by federal authorities of molesting children for 20 years has been added to the U.S. Marshals' 15 Most Wanted list.

Frederick McLean, 55, is wanted on multiple counts of sexual assault on a child, an allegation described by marshals as an understatement.

One of McLean's alleged victims has accused McLean of sexually assaulting her more than 100 times between the ages of five and 12, said Deputy U.S. Marshal Tom Maranda.

An arrest warrant for McLean was issued in Jan. 2005, but authorities believe he began preparing for a life on the run almost six months before that, after family members confronted him about some of the allegations and he admitted they were true, Maranda said.

WATSONVILLE — Martha Victoria Vega deals with some of the most unsavory characters most women would never want to meet — and she's looking for more.

Vega, 30, a police services specialist in the investigations division of the police department, is charged with tracking the city's registered sex offenders and making sure they keep their contact information up to date.

Though 98 percent of the offenders in the city are men, Vega, who sometimes makes house calls in the company of an officer, says she doesn't mind her line of work.

"I don't feel uncomfortable," she says. "If I do get a bad vibe about one, I'll tell a detective and they go along."

By law sex offenders are required to tell law enforcement their whereabouts every year and inform them if they move.

"I know their names, I know their faces, I know where they live," says Vega. who has been following sex offenders for almost two years.

Vega said as of Thursday she had identified 10 offenders who were in the city at some point and have fallen out of sight.

Arrest warrants for four — Cristobal Rocha Fernandez, William Oliver Kelly, Gregorio Alberto Plata and Reymundo Garcia Rodriguez — have been issued.

A fifth man, Manuel Rosas, who is sought by the California Department of Justice, has been out of compliance since 1996.

Capt. Eddie Rodriguez said it's possible the offenders have left the area, died, are in police custody elsewhere or have been deported.

Through Vega's efforts to keep tabs on sex offenders in the city, the police department has achieved a 90 percent compliance rate with offender registrations, Rodriguez said.

Marina man convicted of multiple child molestiation charges

A Marina man is facing multiple life sentences after he was convicted of several counts of child molestation, Monterey County District Attorney Dean D. Flippo announced Friday.

It took a jury two hours to convict Thomas Horton of all counts of child molestation, threatening and dissuading witnesses and indecent exposure involving eight children.

Between 2003 and 2004, Horton molested children and recruited more by having his victims invite their friends to his home. He would offer the children money to clean his house before molesting them, according to the District Attorney's office.

The trial lasted five days. Horton could be sentenced to multiple life sentences.

Monterey County Superior Court Judge Russell Scott will sentence Horton on April 27.

We did manage to get 5 on tape, Corey Ahia, Mitchell Heylek, John Mahon, Erik Pallesen and Christopher Urban.

During court the mental capacity of Heylek was in question therefore I am not going to show the video of him.

The other 4 are fair game. 'Molly' from the Pervert Patrol gave them all a non stop verbal barrage of questions.

Dateline NBC had a crew there today as well because they plan on airing a followup story to their excellent 'To Catch A Predator III".

Gregory John Karnos taken into custody today

Karnos is a registered sex offender. Because he has 2 prior felony convictions the DA's office asked that his bail be increased to $1 million dollars. Judge Schwartz agreed and Greg Karnos was taken into custody on the spot.

This looks like the 3rd strike for Greg.

Karnos is next scheduled to appear for a felony settlement conference on April 14th.

DNA helps catch registered sex offender, but not before there is another victim

Baffled by the molestation and attempted rape of a 10-year-old girl who was attacked in her home in January 2004, Oakland police turned to DNA science to solve the crime.

Within weeks, the state crime lab's computer gave investigators the break they needed: a DNA "cold hit" that linked the crime to a paroled rapist who lived nearby.

But then the police failed to follow up -- until another young girl was assaulted.

Court records show that even though they were provided with DNA evidence that seemed to solve the crime, Oakland Police Department investigators did not contact the suspect until after he allegedly attacked another 10-year-old girl six months later.

The case of registered sex offender Kalonji Lavaro Lee, detailed in documents filed in Alameda County Superior Court, reflects an apparent breakdown in the system by which DNA science is supposed to be deployed to solve crimes.

The parents of the second victim said they were dismayed that police had failed to pursue evidence that might have prevented the attack on their daughter -- information they never knew until they were told about it Wednesday by a Chronicle reporter. They declined to comment extensively because Lee's case is pending.

But they said the police investigator they had met seemed overburdened, complaining that he had a caseload of hundreds of unsolved sex crimes.

Police Seek Sex Offender With Underground Dungeon

COLUMBIA, S.C. -- Authorities in South Carolina are looking for a convicted sex offender. They suspect the man of raping two teens in an underground dungeon behind his home.

Police allege that Kenneth Hinson took a 17-year-old girl from a Darlington County mobile home while she was sleeping Monday night. Police said he bound her mouth, sexually assaulted her, then left her in the underground room. It's described as not much larger than a closet with a four-foot ceiling.

Police said Hinson later returned to the mobile home and took another 17-year-old girl, sexually assaulted her, then left. The teens managed to wriggle free, get out of the shed, walk through some woods and flag down a passing motorist.

Hinson is wanted on kidnapping and criminal sexual conduct charges.

Bible School Teach Charged With Lewd Acts On Child

A man accused of molesting a boy he knew through a children's Bible class he taught at First Advent Christian Church in Tustin was charged Thursday with molestation, officials said.

Roger Warren Evans, 53, of Tustin, is being held on $500,000 bail. He is charged with two counts of committing lewd acts on a child -- doing so over a three-year period -- as well as dissuading a witness, said Assistant District Attorney
Susan Schroeder.

Evans could face up to 20 years in prison if convicted of all charges.

The boy, now 11, was 9 years old when the alleged molestation began, Schroeder said.

Evans, also associated with the Costa Mesa-based Trinity Broadcasting Network, has reportedly admitted to authorities that he fondled the boy's genitals while spanking his bare bottom and got sexually aroused from doing so, according to Schroeder.

Sex Offender Arrested in 1996 Fla. Death

HARTFORD, Conn. -- A database of DNA from convicted sex offenders has linked a Connecticut man to the rape and murder of an 11-year-old girl in Florida almost 10 years ago, police said Thursday.

Robert S. Mitchell, 43, was being held on $5 million bail after being arraigned Thursday as a fugitive from justice. He waived extradition, and will face first-degree murder and sexual battery charges in the death of sixth-grader Cherie Morrisette, police said.

Liz Walters said she had been waiting nearly a decade to find out what happened to her daughter. "There's no such thing as safe neighborhoods," she told The St. Augustine Record on Thursday. "Things happen everywhere."

Connecticut state troopers and New Britain police said DNA from a national database allegedly linked Mitchell to the girl's death.

Cherie's body was found Dec. 8, 1996, in the St. John's River about 10 miles from the apartment she shared with her family in Jacksonville, Fla.

At the time, Mitchell lived in a nearby town, police said.

Local man arrested for child molestation

On March 14, 2006, the Indio Sheriff's Station initiated a criminal investigation involving lewd and lascivious conduct that involved a female victim under the age of fourteen. During the investigation it was determined that the minor met a subject identified as Shane Joseph Espana (21) from the city of Riverside through an Internet chat room. They began a relationship and became romantically involved.

On March 16, 2006, Investigators contacted Espana in the city of Riverside. As a result of the investigation he was arrested for a lewd and lascivious conduct with a child and he was booked at the Indio Jail. The name of the victim will not be released because of her age. Two bills make it out of the Senate Public Safety Committee yesterday.

SB 1178, authored by Senator Jackie Speier (D-San Francisco), was introduced January 13, 2006.

There is some mis-information in the media about this bill so allow me, your fearless blogger, to set it straight.

News10.net writes that SB 1178 "is proposing that high-risk offenders be required to wear global positioning satellite tracking devices for the duration of their probation or parole."

The Press Enterprise writes that SB 1178 "would require satellite-tracking of the state's estimated 3,000 high-risk sex offenders during their paroles."

Sounds good but they both got it wrong.

Here is what the bill actually says (from the legislative counsels digest):

This bill would require a person who is convicted of an offense that requires him or her to register as a sex offender, and who is determined to be at a high risk of reoffending, to be electronically monitored while on probation, unless the chief probation officer determines that such monitoring is unnecessary for a particular person.

Contrary to the above mentioned media reports, "GPS" and "satellite-tracking" are not mentioned in the bill. Electronic monitoring is far different than GPS.

Nor are "high-risk sex offenders", such as David Allyn Dokich, mentioned in the bill. It states sex offenders on parole who are determined to be high risk and this determination is made by the Department of Corrections. It also gives them a big fat out when it says "unless the Department of Corrections and Rehabilitation determines that such monitoring is unnecessary for a particular person."

So the same people who place high risk sex offenders in communities full of children, the same people that play the 'sex offender shuffle', these are the people who are going to be the ones who decide who gets a bracelet? Thanks but no thanks.

Now lets look at Senate Bill 1128 authored by Senator Elaine Alquist (D-San Jose). It was introduced January 9, 2006.

It is being called the Sex Offender Punishment, Control, and Containment Act of 2006. That sounds an awful lot like the Sexual Predator Punishment and Control Act of 2006 (Jessica's Law).

Well it is an awful lot like SB 588 (Jessica's Law) and even says "this bill incorporates a number of the sentencing revisions proposed in SB 588 and the proposed Jessica's Law initiative."

What it does not have is any restrictions on where sex offenders may live nor does it have any provisions for tracking them. One thing it does have that I like is it increases the information available to the public on the Megans Law website. It would add Sexually Violent Predator information and risk assessment information.

It's curious that on January 10th of this year Senator Alquist voted against a bunch of bills including SB 588 (Jessica's Law). She also voted against SB 722 which would have placed sex offenders on parole for life if their victim was under 12, SB 1044 which would have increased the penalties for the worst sex offenders and would require GPS monitoring for all sex offenders while on parole and create a new law to deal with luring. She also did not vote for SB 1074 which would have required all high risk sex offenders to be monitored by GPS for life and would require the Department of Corrections and Rehabilitation to share parolee information with local law enforcement.

It is interesting that both of these bill were introduced this January. One has to wonder if the over 700,000 signatures gathered to get the real Jessica's Law on the ballot had anything to do with these bills sudden appearance.

Child porn ring transmitted acts live on Web

CHICAGO (Reuters) - U.S. and Canadian authorities said on Wednesday they had cracked an international child pornography network that in some cases transmitted molestations live over the Internet.

"These are the worst imaginable forms of child pornography," said U.S. Attorney General Alberto Gonzales, adding that one case involved the abuse of a toddler less than 18 month old.

Twenty-seven people from nine U.S. states and Canada, Australia and Britain, are charged with possession, receipt, distribution and manufacture of child pornography in connection with the case, authorities said.

Twenty-six of the suspects have been arrested and one is still at large.

"This international undercover investigation revealed an insidious network that engaged in worldwide trafficking in child pornography, including live molestations of children transmitted over the Internet," Gonzales said.

Authorities said they have identified seven victims including the toddler whose molestation in April by a suburban Chicago man was transmitted live via an Internet chat room to someone using the screen name "Big_Daddy619."

Monitoring sexual predators with GPS is a worthy expense

Every parent knows the sinking feeling. When we learn of another child killed, kidnapped or assaulted, we remember just how vulnerable our children can be. The sad fact is that more than two-thirds of all victims of rape and sexual assault are under the age of 18.

As a professional prosecutor, I have helped send murderers, rapists and child molesters to prison. Like everyone in the law enforcement community, I am doing everything in my power to protect the most vulnerable victims -- our children.

But I can't say the same right now for the state of California. A powerful new technology is available to protect our children, but it remains relatively unused because of political battles in Sacramento.

The device is called GPS (global positioning system), and it can be used to track the movements of convicted child predators and other sexual offenders once they leave prison. Many law enforcement professionals want to use this new tool to safeguard our communities by providing 24-hour monitoring. While there are more than 2,500 registered sex offenders in Santa Clara County, the frightening reality is that their daily whereabouts are largely unknown to law enforcement.

The hard truth is that we can rehabilitate drug users, but sexual predators are a different kind of criminal. They are subject to an untreatable pathology. And we know that once released, they are likely to repeat their offenses and victimize again.

Under new bill someone convicted of a second sex offense against a child could be subject to execution

OKLAHOMA CITY — Repeat sex offenders could be executed under a bill approved Tuesday by the Oklahoma Senate.

Backers of the legislation, which now goes to the House, called it a groundbreaking measure to protect children, while opponents called it extreme and unconstitutional.

“This is a redneck re-election bill,” said Sen. Bernest Cain, D-Oklahoma City. “This is a way to get your rednecks out to vote, who believe we ought to fry a lot of people.”

Under the bill by Sen. Jay Paul Gumm, D-Durant, a second sex offense against a child could subject someone to execution or life in prison without parole.

Some senators questioned the bill's constitutionality since the U.S. Supreme Court had required aggravating circumstances to be present in murder cases that lead to the death penalty.

“Child molestation in many ways is the most heinous of crimes,” said Gumm. “We allow the death penalty for someone who has killed the body. Why in the world would we allow someone to escape who has killed the soul?”

Daniel Allen sentencing delayed

Allen was supposed to be sentenced this Friday. He has plead guilty to an attempted lewd act with a child under 14.

He is the first one I know of to have plead guilty and would have been our first chance to see what type of sentence these perverts will get.

Deal Reached in Franciscan Sex Abuse Suits

The Roman Catholic Church has tentatively agreed to pay more than $28 million to 25 people who say they were molested by Franciscan friars, attorneys involved in the negotiations said Monday.

The deal marks the first settlement involving the Los Angeles Archdiocese since the sex-abuse scandal began four years ago. It comes as lawyers were preparing to try the first cases against the Franciscan Friars of California and the Los Angeles Archdiocese for failing to protect children from predatory priests.

"We are delighted to see the successful resolution of these cases involving the Franciscans and would hope it would stimulate comparable participation with other orders as well," said attorney J. Michael Hennigan, who represents Cardinal Roger M. Mahony in the clergy sex-abuse litigation. The archdiocese, slated to contribute less than $2 million, is still working with insurers to come up with its share of the settlement, he said.

Though named in most of the lawsuits, the archdiocese played a minor role in the proposed deal, according to lawyers, because Franciscan priests and brothers allegedly molested most of their victims at the now-defunct St. Anthony's Seminary in Santa Barbara. A few cases involved Franciscans at church parishes within the archdiocese.

Menlo Park Man Sentenced to Prison for Molestation

A Menlo Park man accused of molesting his 7-year-old niece multiple times was sentenced to 18 years in prison after pleading no contest in a San Mateo County courtroom.

Urbano Banderas, 43, pleaded no contest on Monday to three counts of committing a lewd act with a child under the age of 14 by means of force, violence or fear, the San Mateo County District Attorney's office reported.

Banderas was arrested on June 25 after he brought his young niece, who lives in Shafter, Calif., to his Menlo Park home for a two-week visit, according to the district attorney's office.

During the visit, Banderas sodomized and digitally penetrated his niece. He also reportedly forced his niece to engage in sexual intercourse with him, according to the district attorney's office.

The district attorney's office reported that during the sexual assaults, Banderas told his niece that he would kill whomever she told about the attacks.

The victim returned home and didn't mention what had happened until her mother saw hickeys on her neck and questioned her, the district attorney's office reported.

Banderas, who remained in custody in lieu of $500,000 bail since his arrest in June, was scheduled to go to trial on April 10.

What is going on with Riverside Judge Bernard J. Schwartz?

Who is Riverside Superior Court Judge Bernard J. Schwartz and why should we care?

Judge Schwartz is presiding over the the cases of the Internet Perverts busted by Dateline NBC / Perverted Justice / Riverside County Sheriff's Department in January.

When I first heard Judge Schwartz was presiding over these cases I spoke with someone who has been in the DA's office for many years to get their opinion of him. They told me they thought he was a good and fair judge.

That was good to hear and certainly better than finding out we had some soft on crime weenie Judge who was going to let all these perverts go with a slap on the wrist.

Well it has since come to light that Judge Schwartz has some legal issues of his own. This may be of concern considering what has been going on with Judge Connor in Ohio.

Here's the deal. Last July Judge Schwartz was pulled over in Pismo Beach for drunk driving.

In September Judge Schwartz pleaded no contest and was convicted of violating California vehicle code 23152(b), driving under the influence.

There is another problem though. According to Pismo Beach Police Judge Schwartz repeatedly tried to avoid being arrested because he is a judge. Considering he had a blood alcohol level TWICE the legal limit it's amazing he even remembered he is a judge.

That has landed Judge Schwartz in a heap of trouble with the Commission on Judicial Performance.

Judge Schwartz was supposed to respond by yesterday. That response is not yet available for the public. I will post it when it becomes available.

Judge Schwartz has allegedly used his position of authority to try to circumvent the law for his own personal gain.

Let's hope Judge Schwartz does not allow his personal legal issues influence the outcome of the proceedings before him. He is up for re-election this June. Rest assured, we will be watching Judge Schwartz and how he handles these cases.

NOTICE OF FORMAL PROCEEDINGS

To Bernard J. Schwartz, a judge of the Riverside County Superior Court from October 9, 2003, to the present:

Preliminary investigation pursuant to Rules of the Commission on Judicial Performance, rules 109 and 111, having been made, the Commission on Judicial Performance has concluded that formal proceedings should be instituted to inquire into the charges specified against you herein.

By the following allegations, you are charged with willful misconduct in office, conduct prejudicial to the administration of justice that brings the judicial office into disrepute and improper action within the meaning of article VI, section 18 of the California Constitution providing for removal, censure, or public or private admonishment of a judge or former judge, to wit:

COUNT ONE

On the night of July 16, 2005, in Pismo Beach, California, you committed the crimes of driving while under the influence of alcohol in violation of Vehicle Code section 23152(a) and driving while having a .08 percent or higher blood alcohol level in violation of Vehicle Code section 23152(b). You had a blood alcohol level of .17, .18 percent, as evidenced by your breath test. On September 6, 2005, upon a plea of no contest in San Luis Obispo County Superior Court case number M376280, you were convicted of violating Vehicle Code section 23152(b).

Your conduct violated the Code of Judicial Ethics, canons 1 and 2A.

COUNT TWO

Before and after your arrest by the Pismo Beach Police Department for the crimes referenced in count one, you repeatedly attempted to avoid being arrested and incarcerated and to otherwise receive preferential treatment because you were a judge, as exemplified by the following.

Pismo Beach Police Officer Trimble observed your vehicle "swerving all over the road" and pulled you over after you twice violated Vehicle Code section 21460(a) (driving to the left of double parallel solid lines). It appeared to the officer that you had been drinking. When he requested that you take a preliminary alcohol screening (PAS) test, you responded, "Did you run my license yet?" When the officer said that he had not and again asked you to take the PAS test, you responded, "Why don’t you run my license and then we can talk?" When the officer asked if you were trying to tell him that you were a police officer, you responded, "No, I’m a judge."

Pismo Beach Police Sergeant Portz arrived on the scene and you took a PAS test. Officer Trimble informed you that the test indicated that your blood alcohol level was .15, which was over the legal limit of .08. You asked if you could just go back to the hotel (where you were staying for the weekend) and leave your car. The officer told you "my hands are tied" and there was "nothing I can do."

Officer Trimble then asked you questions regarding your drinking and driving. You claimed to have had only "a couple of glasses of wine," denied being under the influence of alcohol, and asked, "Is this really necessary, all this stuff we have to go through?" Sergeant Portz responded that they had to do their job "unbiased."

After you performed poorly on field sobriety tests, Officer Trimble asked if you would agree to another PAS test. You again asserted, "I’m really not under the influence. I’ve had a couple of drinks, but I’m really not under the influence." Sergeant Portz again told you "we’re just trying to do our job, unbiased and fairly to everybody."

When you took a second PAS test, Officer Trimble informed you that it indicated a higher alcohol level (.18) than the first test. When the officer told you that you were under arrest and asked that you place your hands behind your back, you responded, "Can you consider the circumstances of it, and I can just leave my car here, and take me back to the hotel; is that a possibility?" Sergeant Portz again told you "we have to be fair and unbiased, sir." You responded, "but you know what this is going to do; this will substantially impair my career." Officer Trimble said that "if I let you go, it could impair my career." You then said, "you don’t have to let me drive; you could just let me go home." Officer Trimble told you "I can’t do that."

You persisted by asking, "can’t you guys consider the circumstances?" Sergeant Portz responded, "Sir, I’ve already told you that we’ve made our decision. This is the way it’s got to happen." You again asserted, "this really is going to affect my career, I don’t know if you realize that." When Sergeant Portz suggested that you would still have a job, you responded, "No, no, I really won’t." You informed the officers that you would have to "self-report" the DUI to the Commission on Judicial Performance.

After being placed in a patrol car, you said, "You know what? Just leave my car there; just take me back to the hotel and I’ll go to sleep. You can have my keys." After Sergeant Portz told you two more times that they had to be "fair" with everyone, you responded, "I know. But, I’m all of a mile away from the hotel. … I know you guys are doing your job, but this is not good for me. I’m running for election next year and this is not a good time."

After you were taken to the police station, you asked to speak to a "lieutenant or captain." Sergeant Portz told you that you would first have to take the breath test (that you had chosen to take rather than a blood test) to determine your blood alcohol level. Later, but still before taking the breath test, you again asked, "Is there a lieutenant or captain or somebody that I can speak to?" The sergeant again told you that you would first have to take the test.

You again talked about the Commission on Judicial Performance and being up for reelection and losing your judgeship. Sergeant Portz again told you that they had to be "fair and unbiased." You responded, "But, this is a substantial issue with my career. All you have to do is just take me back to the hotel and I’ll go to sleep and wake up in the morning and get my car." You again asked the sergeant, "Is there someone I can talk to before I take the test?" He reiterated that you first had to take the test. When the sergeant informed you that the result of the breath test was ".17, .18," you recognized "that’s not good" and again asked to speak to a lieutenant or captain.

After Sergeant Portz informed you that you would be held in custody until the next morning or until your wife, who was several hours away, could pick you up, you asked the sergeant if he could telephone the "on-call judge." Despite the sergeant telling you that he could not "because you are a citizen of the State of California and we’re treating you like everybody else," you persisted in asking him to call a judge that you could talk to.

Your efforts to obtain preferential treatment having failed, you told Sergeant Portz and Officer Trimble "there is no professional courtesy here anymore" and used vulgarity. You then stated, "You guys come in and appear before me" in court on certain matters. When the sergeant asked you why you brought that up, you said, "because I’m not being treated fairly." The sergeant responded, "We’re treating you about as fair as we can, same as everybody else. What you are asking for is special treatment." You acknowledged, "To some degree, I guess."

Your conduct violated the Code of Judicial Ethics, canons 1, 2A and 2B(2).

JUDICIAL PERFORMANCE COMMISSION INSTITUTES FORMAL
PROCEEDINGS CONCERNING JUDGE BERNARD J. SCHWARTZ

The Commission on Judicial Performance has instituted formal proceedings to inquire into matters concerning Judge Bernard J. Schwartz of the Riverside County Superior Court. The commencement of formal proceedings is not a determination of judicial misconduct. The formal proceedings concern allegations that the judge (1) committed and was convicted on a plea of no contest to the crime of driving while having a 0.08 percent or higher blood alcohol level; and (2) repeatedly attempted to avoid being arrested and incarcerated and to otherwise receive preferential treatment because he was a judge. It is alleged that these actions constitute willful misconduct in office, conduct prejudicial to the administration of justice that brings the judicial office into disrepute and improper action.

In accordance with the rules that govern Commission proceedings, a hearing will be conducted by Special Masters appointed by the Supreme Court. At the hearing, the parties will have an opportunity to introduce evidence and examine and cross-examine witnesses. Judge Schwartz is represented by attorney Edward P. George, Jr., in Long Beach, California.

Following completion of the hearing, the Special Masters will provide the Commission with a report containing findings with respect to the charges. The parties will have an opportunity to present their views on the report to the Commission through briefing and argument. If the Commission determines that charges are proved by clear and convincing evidence, it is empowered to remove, censure, publicly admonish, or privately discipline the judge. Charges that the Commission determines are not proved will be dismissed. A determination by the Commission to remove, censure, or admonish a judge is subject to discretionary review by the Supreme Court upon petition by the judge.

The Notice of Formal Proceedings is available for public inspection at the Commission office. A copy of the Notice of Formal Proceedings is also posted on the Commission’s Web site at www.cjp.ca.gov (under "Press Releases"). Judge Schwartz’s Answer to the notice is presently due March 13, 2006. Upon filing, Judge Schwartz’s Answer will be made available for public inspection.

Judge John Connor is a real piece of work. 46 year old Andrew Selva was indicted on 20 counts of rape. Who were his victims? Two young boys ages 5 and 12. In the end Selva plead guilty to just two charges.

How much time did Judge Connor give this admitted child rapist who has been labeled a sexual predator?

None. Not a single day in prison.

Why would a judge do this? Well according to Judge Connor "he's got a disease like I've got a disease".

According the the O'Reilly Factor, Judge Connor has been arrested 8 times for DUI and has 3 convictions for DUI. He was even reportedly arrested on a cocaine charge.

Bill O'Reilly said that Judge Connor once sentenced a guy with a long rap sheet to 9 months for DUI. The guy violated his probation but Judge Connor did not sent him to jail. The same guy later killed 2 people while DUI, a 20 year old boy and a 19 year old girl.

Apparently Judge Connor is of the belief that alcoholism and raping children are both diseases that need treatment. After all, you don't lock someone up for having a disease.

That's great news for child rapist Andrew Selva who is now sitting at home doing who knows what.

Does anyone still question why we have mandatory minimum sentencing here in California?

EDMOND, Ore. - Eighteen years have gone by since Rickie Morton was molested as a young boy, but he retains a vivid memory of the man slipping into the bedroom of his Sacramento home in complete darkness.

"The house is just pitch black," the 27-year-old former area baseball star recalled in an interview last week. "All I could see was this red cherry, this cigarette just creeping toward me."

Behind the lit cigarette was Timothy Lee Boggs, a car salesman, welder and fishing guide who had taken 9-year-old Rickie and his family on fishing trips.

Only much later would the family learn that Boggs had been convicted four years earlier of fondling another 9-year-old boy.

Boggs is now 51 and considered by the state to be a sexually violent predator, a classification that landed him in the Atascadero State Hospital in 1999 after eight years in prison. Because he had more than one victim and was found by a court to have a mental disorder that could make him likely to re-offend, Boggs was sent to the state hospital's treatment program.

Now, he is poised to be released somewhere in Sacramento County as only the fifth man to complete the state's four-stage treatment program inside Atascadero since 1996. More than 550 men have been committed to the program at Atascadero, but more than two-thirds refuse to take part in treatment there, a recent Bee investigation found.

Boggs' release has been scheduled for 10 months, but has been delayed repeatedly while officials figure out where he can live while undergoing the strict monitoring and outpatient therapy required in the fifth and final stage of treatment for such offenders.

Boggs has declined to be interviewed, but once he is moved out of Atascadero he can expect to face the same scrutiny that accompanied the releases of some of California's most notorious sex offenders.

Patrick Ghilotti, Brian DeVries, Cary Verse and Matthew Hedge all completed the treatment program inside Atascadero, and upon release all four of them were hounded by loud protests and media attention.

Verse was forced from four homes by such protests, and Hedge lasted only six weeks on the outside before state officials won a court order returning him to Atascadero.

Tormented by the memories of repeated molestations, Christina Barquera considered giving up as she testified in a Riverside County courtroom against the relative accused of sexually abusing her as she grew up in Corona.

But her fear dissolved into determination. Two years earlier, she had steeled herself to confront Donald Edward Nelson on an autumn afternoon as Corona police secretly listened. A jury that heard the 1999 taped conversation and Barquera's later testimony convicted Nelson of 52 counts of child molestation. He was sentenced to 110 years in prison in 2001.

A relieved Barquera figured Nelson was locked away. She felt liberated, vindicated.

Nearly five years later, Barquera is again struggling with anxiety, anger and resolve as Nelson walks free, awaiting a new trial after his first conviction was nullified by a U.S. Supreme Court decision in an unrelated case.

"It's like being victimized all over again, knowing you're going to have to go back to trial and relive those moments all over again," said Barquera, now 26, who agreed to be identified for this story. "You try so hard to suppress everything and to block it out and you think it's finally over and then one day you read (a newspaper) article and you realize you have to ... relive it all again."

Virginia defended Dokich during his second rape trial here in Riverside. Now she is defending Inderjeet Singh.

Virginia's website says they "use psychiatrists, forensic experts, and testimony to call into question evidence and the state of mind of the accuser."

That's fancy talk for attacking the credibility of the victim.

Let's hope that, like in the case of David Allyn Dokich, Virginia Blumenthal fails and Inderjeet ends up behind bars.

Sacramento -- When Roderick Hickman abruptly quit his job as California's top prisons official last month, a chorus of critics chided him for bungling the effort to turn around one of the nation's most dysfunctional law enforcement agencies.

In two years on the job, Hickman had infuriated nearly everyone involved in state corrections. The politically potent prison guards union charged that violence inside prisons had risen under his watch and ridiculed him almost daily on an Internet blog popular with prison employees. Inmate advocates, meanwhile, suggested Hickman said all the right things about reforming the system but ignored basic problems -- one lawyer noted that while Hickman organized a bureaucratic revamping of the department that included a name change, doctors at San Quentin State Prison went without a sink to wash their hands in between seeing patients.

But the consensus that Hickman failed to enact real change misses a key point that illustrates problems both with California's prisons and its politics. To truly fix what's broken behind bars in this state, experts say that the governor and Legislature -- not the head of the corrections system -- need to take action.

"In essence, we're blaming the wrong person for the prison problem," argues Joan Petersilia, a nationally-known corrections expert at UC Irvine. "Prison reform can't really happen inside prisons."

Scholars such as Petersilia who have studied California's overcrowded, $8 billion corrections system have repeatedly concluded that many of the system's troubles stem from poorly thought out criminal justice policies.

Sentencing laws enacted more than 30 years ago, and repeatedly described as a failure, require nothing of inmates, who sit in cells or on yards instead of entering drug treatment or vocational education programs. Corrections administrators have little power to determine when an inmate is truly ready to leave prison, and that results in the daily release of dangerous people back into the neighborhoods they previously terrorized. Overburdened parole agents are required to monitor virtually every parolee, leaving the agents little time to concentrate on the parolees most likely to pose a threat to citizens. That has resulted in this shocking fact: More than 20,000 California parolees are unaccounted for on any given day.

Man pleads guilty in child-porn case

A Joshua Tree man pleaded guilty Friday in U.S. District Court in Los Angeles to a charge of felony possession of child pornography.

Because the defendant, Gordon Douglas Cope, 58, has a prior conviction for sexual assault of a minor, he faces a mandatory minimum sentence of 10 years in federal prison, the U.S. Attorney's Office in Los Angeles reported in a statement.

Cope could face as many as 20 years in prison.

Authorities who searched Cope's computers found 670 images and 20 videos of children, some as young as 5, engaged in sexual acts, prosecutors said. Law-enforcement officials identified victims of sexual assault in 83 images and two videos.

Under a plea agreement, Cope admitted he knew the images were pornography and depicted children under 12 years of age, according to prosecutors.

Undercover FBI agents, who posed online as people interested in child pornography, visited Internet chat rooms Cope had established. The chat rooms were used to trade and publish images of child pornography.

Cope pleaded guilty before U.S. District Judge George P. Schiavelli, who is scheduled to sentence Cope on July 10.

Registered sex offender gets 375 years on new charges

A jury found 71 year old Jon Gary Schnabel, a real estate broker, guilty of 15 counts of committing a lewd act on a child under the age of 14. He has been sentenced to 375 years in prison.

He had been charged with six counts of child molestation involving two children in the past six years.

According to Citrus Heights Police, Schnabel would befriend the children of his adult clients. He would have the children put what he called 'medicine' on his genitals.

The charges are similar to the 1963 case that led to his registration as a sexual offender. He did just eight short months for that crime.

That victim, now 50 years old, faced Schnabel at his sentencing. Good for her!

Keep in mind the average pedophile molests between 30-60 children BEFORE he is arrested the first time, and an average of 360-380 children in his/her lifetime.

This pervert has been a registered sex offender for over 40 years! How many kids has he abused in that time? Apparently his 8 months behind bars the first time they caught him did not discourage him from doing it again.

SANTA ANA - Three young men were sentenced to six years each in state prison on Friday for sexually assaulting an unconscious teenage girl during a wild weekend of partying.

Gregory Haidl, Keith Spann and Kyle Nachreiner hoped to receive probation for the July 2002 assault in which they videotaped themselves violating the girl inside the home of Haidl's multimillionaire father.

But the judge said the former Rancho Cucamonga High School students instead deserved prison because they seem more consumed by "self-pity" than any true sorrow for the harm they caused their victim.

"Each defendant has been slow to express remorse," Judge Francisco Briseno said.

Haidl, Spann and Nachreiner were all 17 when they videotaped themselves inserting a pool cue, juice can, Snapple bottle and cigarette into the 16-year-old girl while she was passed out drunk atop a pool table.

They had their way with the girl's limp body inside the Corona Del Mar home of Haidl's father, who was then an Orange County assistant sheriff.

Bad sex-offender laws

CALIFORNIA REALLY NEEDS TO examine and modify its sex offender laws. The California Supreme Court recently overturned a law requiring people 21 or older who are convicted of having oral sex with a 16 or 17 year old to register as sex offenders for life.

Shocking and disgusting though it may be, it is the correct decision in this case because it keeps punishment equal for similar crimes.

That is to say, that it is the law that is fouled up here and not the courts.

There are parts of the state's sex offender laws that are inane and need to be revised.

Other cases of adults 21 or older convicted of having sex with 16 and 17 year olds do not necessarily require the convict to register. It is unjust to treat one sexual offense differently from the other.

However, the law needs desperately and immediately to be revisited. Sex is sex.

Those 21 years or older should be having neither oral sex (which is sex, people) nor intercourse in any manner or position with minors.

If they do so, they should be convicted and treated as sex offenders. Period.

It was a mess at the Justice Center today. The courtroom is far too small for this many defendants. The hall outside the courtroom was packed.

A video crew brought a camera into the courtroom just after 8:30 am. A source has told me that Dateline NBC intends to do a followup show. That should be interesting but I do not know when it will air.

I did not see any other media there. That's a shame because these perverts depend on staying below the radar. They count on the press and public losing interest. I for one hope that does not happen.

As you can see 13 out of the 16 were for a felony settlement conference. Bet you want to know what happened, don't you.

I can sum up what happened with one word: Nothing!

Nicolas Cocos, Stephen Walter Coates, Roberto Forte, Gregory John Karnos (registered sex offender), Phillip Thomas Jaruhungs , Peter Christopher Moore, Inderjeet Singh, Danny Lee Swinney and Keith Allen Williams all had a felony settlement conference and in each case it was continued to a later date. They all remain free on bail.

Charles Carlton Harding had a felony settlement conference and it too was continued. He remains in custody.

Paul Constantinescu and Kurt Horst Lemke each had a felony settlement conference. The disposition of these conferences is unknown at this time but odds are they too were continued. They each remain free on bail.

That was a colossal waste of time and money.

You know time and time again we hear how our courts are overwhelmed, how we don't have enough judges, bla bla bla.

A judge, a bunch of bailiffs, a court reporter, a clerk, other staff, prosecutors and a boatload of defense attorneys all get together for hours and accomplish absolutely nothing.

Well it's not going to get any better when all they do is continue the cases to a later date. Add the fact that the court starts late, takes way too many 15 minute breaks, takes a long lunch and leaves early and it amazing that anything ever gets done.

Richer Daniel Breault was present in court for his felony settlement conference. His defense was not present, his conference continued to a later date and he remains free on bail.

Hoi Dick Chan was in court for his preliminary hearing today. A date was set for bail review. His bail was recently increased to $750,000. He remains in custody.

Eduardo Ernesto Guillen was present in court for his arraignment. He pleaded not guilty to charges of attempted child molestation and remains out on bail.

Alvin Joseph Hall Jr. was present in court today for his arraignment. The disposition is unknown at this time and he remains free on bail.

However not all was lost. We shot some video and 'accidently' over heard some conversations.

Kurt Horst Lemke seemed absolutely giddy when Paul Constantinescu arrived, trotting over and shaking his hand. Yeah those perverts gotta stick together. It looked like they were talking with Nicholas Cocos but it was hard to tell for sure. Most of these guys have cleaned up since they appeared on Dateline NBC and look different now.

Eduardo Ernesto Guillen was chatting it up with Phillip Thomas Jaruhungsin in the hallway.

Peter Christopher Moore was speaking with his attorney outside. His attorney told him he does not think he will do any jail time. Yep, that's what he said.

Faheem Nawar Williams arrested for alleged child molestation

The Riverside County Sheriff's Department Palm Desert Station received information about a minor having a relationship with an adult. The minor had conversations about the relationship with family members who immediately reported the incident to law enforcement.

On the morning of Wednesday, March 8, 2006, the adult that having the relationship with the minor was asked speak to investigators at the Palm Desert Station.

After the interview, Faheem Nawar Williams, age 25, a resident of Palm Desert, was arrested and booked into the Indio Jail for 6 counts child molestation and his bail has been set at $1,000,000.00.

Prosecutor says hospital worker admitted 'countless' molestations

A respiratory therapist at Children's Convalescent Hospital confessed to molesting "countless" disabled patients, targeting the comatose and most brain-damaged, a prosecutor said Friday.

Wayne Albert Bleyle, 54, pleaded not guilty to two counts of child molestation and 24 counts of child pornography, but the prosecutor said in court that he confessed during a phone interview while he was in New York state visiting family.

"One of the agents who interviewed him said, 'How many kids are we talking about?'" said Laura Gunn, a San Diego deputy district attorney. "The defendant, who was in New York at the time looking out at the snow, looked out at the snow and said, 'How many snowflakes are there out there?'"

"He averaged about two kids a week, and he specifically chose children who were the most brain-damaged, most comatose, most nonverbal children who could never say anything about it," Gunn told Superior Court Judge David Szumowski, who set bail at $5 million, far more than the $3 million bail requested by prosecutors.

The complaint identified two alleged victims, both girls under 14 years old, but authorities said there may be more. Asked by reporters to estimate how many children were allegedly molested, Gunn said, "I don't know if we will ever know."

Eddie Chan in custody

Some people just don't get it.

Eddie Chan, aka Eddie Hoidick Chan, aka Eddie Hoi Chan, aka Hoi Dick Chan, one of the perverts busted in the Dateline NBC / Perverted Justice / Riverside County Sheriff's Department sting operation in January, has been taken into custody.

Someone from Perverted Justice spoke with John and Ken a couple of weeks ago about the Laguna Beach sting operation where they busted 13 Internet perverts.

They told John and Ken that during the Laguna sting a couple of the perverts from the Riverside sting made contact with their Laguna decoy. Reportedly one of the Riverside perverts said he just does not believe in age limits. Well that's a big suprise.

So who were the 2 Riverside Internet perverts that were out on bail and able to allegedly make contact with the Laguna Internet sting decoy? I am not sure, I wasn't there.

However (you knew this was going somewhere) I did find some new information about Eddie Chan, information that may indicate he is one of the two in question.

For his participation in the Riverside sting, Eddie Chan was charged with the standard attempted child molestation charge. There is an additional charge of "Harmful matter sent w/intent of seduction of minor".

Eddie was out on bail. Most of the Riverside perverts had bail set at $50,000. Additional charges and/or previous convicitons resulted in an increased bail.

According to court documents, on February 24th there was a felony settlement conference for Eddie Chan. During this conference the DA informed the court of "possible additional misconduct" and asked that bail be increased to, are you ready, ONE BILLION DOLLARS. I am not sure if that is a typo, perhaps Dr. Evil was the court reporter, who knows but that is what is in the court record, $1,000,000,000.

Well that motion by the DA was denied by Judge Bernard J. Schwartz. However the court did issue the following orders:

COURT ORDERS DEFT TO HAVE NOT USE OF COMPUTERS IN ANY ILLEGAL ACTIVITY.
COURT ORDERS DEFT NOT TO ACCESS ANY SITES OF ILLEGAL CONDUCT.

Does anyone really think that will stop an Internet pervert?

Thankfully the DA was persistent and there was a motion for bail review on March 3rd. The court read the transcript of "further contact online". The DA asked that the bail be increased to one million dollars this time.

The court agreed and increased the bail for Eddie Chan to $750,000. It looks like Eddie was not able to post that amount of bail and was remanded to the custody of the Riverside County Sheriff's Department. Yep, Eddie is now behind bars.

That's a great job by the DA's office and whoever got the transcript to them deserves a big thank you too.

Sex offender registry: The measure has already passed in the House

WASHINGTON - Elizabeth Smart, whose kidnapping in 2002 drew national attention, encouraged senators to approve a national sex offender registry bill that was passed by the House on Wednesday.

“I don't want to see others go through what I had to go through,” said Smart.

The legislation makes it a crime for sex offenders not to register with their state and requires states to share information when an offender moves to a new state.

It passed the House on a voice vote and has broad support, but has been delayed because Democratic members insist that it include hate crimes legislation opposed by Republican leaders.

The National Center for Missing and Exploited Children estimates there are about 550,000 sex offenders in the United States, and about 150,000 have failed to register.

“I think this is a great bill and it needs to be passed,” Smart said. “I think it will affect a lot of people for good and can make our country a safer place.”

Smart was abducted from her bedroom June 5, 2002, launching a sweeping search and drawing attention from around the world. She was missing for nine months, but was found with her alleged kidnappers on March 12, 2003.

Bills would toughen sex offender notification laws

WASHINGTON — Convicted sex offenders would have to check in with local law enforcement at least twice a year and would face prison time if they didn't under proposals in Congress to strengthen registration and community notification standards.

The bills also would require states to register offenders prior to their leaving prison and double the time — from 10 years to 20 — that offenders must remain registered.

The legislation would be the biggest overhaul of federal sex offender laws since the mid-1990s, when Congress enacted minimum rules that states had to follow in tracking sex offenders and alerting neighbors to their presence.

Loopholes in state laws and a lack of money to track offenders have left wide gaps, advocates say. The National Center for Missing and Exploited Children estimates that of the nearly 550,000 registered sex offenders nationwide, as many as 100,000 are unaccounted for.

In pushing for tougher monitoring, advocates point to the murder of Jessica Lunsford. Authorities say the 9-year-old schoolgirl from Florida was kidnapped, raped and buried alive a year ago by a registered sex offender whom police had lost track of because he had moved.

Congress is working on legislation designed to better track sexual predators as they move from prison to communities and from state to state. Details are still being worked out, but the consensus is that some states need to do a more thorough job of registering offenders, and the federal government ought to help states monitor offenders' whereabouts and notify local communities.

Lawmakers are divided on how far states should have to go.

Where is the Kids Caucus in California?

In my never ending quest to provide you with the latest legislative information regarding sex offenders I have stumbled across a curious fact about California. There is a caucus for just about everything except children.

A caucus is a group of legislators that share something in common or have a common goal.

There is a Repulican Caucus, a Democratic Caucus, a Black Caucus, a Latino Caucus, an Asian Pacific Islander Caucus, a Smart Growth Caucus and even an LGBT Caucus. That's not a fancy sandwich, it stands for Lesbian Gay Bisexual Transgender.

Why no caucus to push kids issues?

I know they don't turn out in record numbers to vote. As a matter of fact I believe 0% of kids voted in the last election. But they still deserve to have someone looking out for them.

Could it be that there are just not enough children in California to warrant a caucus of their own? Doubtful, I don't think it's a stretch to say there are more kids in California than all the 'LGTB's' combined, but somehow they managed to get a caucus.

Maybe it's because kids as a whole do not make big campaign contributions. Could that be why they don't have a caucus? Just because the children of California are at the lower end of the income bracket does not make their concerns any less important. It's not their fault labor laws prevent them from making a decent living.

The bottom line is kids have no voice of their own. They depend on us to be their voice, to stand up for them and to protect them from evil.

We are making progress but we have a long way to go. Let's make sure we continue to be heard for the sake of all the children of California.

U.S. Department of Justice reports that 1 in 3 girls and 1 in 7 boys are molested before the age of 18.

An estimated 61% of violent sex offenders in State prisons have a prior conviction history.

An estimated 1 in 4 imprisoned rape and sexual assault offenders has a prior history of a violent crime and 1 in 7 have been previously convicted of a violent sex crime. (U.S. Department of Justice, Bureau of Justice Statistics, February 1997)

67% of all victims of sexual assault reported to law enforcement were minors and 34% of those victims were under the age of 12. (National Incident-Based Reporting System)

Since 1980, the number of prisoners sentenced for violent sexual assault (other than rape) has increased by an annual average of nearly 15% -- faster than any other category of violent crime and faster than all other categories except drug trafficking. (U.S. Department of Justice, Bureau of Justice Statistics, February 1997)

FBI studies have shown that pornography is very influential in the actions of sex offenders and serial murders. Statistics show that 90 percent of the predators who molest children have had some type of involvement with pornography. They use pornography and child pornography to aid them in their molestations.

The average pedophile molests between 30-60 children BEFORE he is arrested the first time, and an average of 360-380 children in his/her lifetime.

Convicted rape and sexual assault offenders serving time in State prisons report that two-thirds of their victims were under the age of 18, and 58% of those said their victims were aged 12 or younger. (U.S. Department of Justice, Bureau of Justice Statistics, Sex Offenses and Offenders, An Analysis of Data on Rape and Sexual Assault, February 1997)

Women who had been raped as children were almost four times more likely than non-victims to make a serious attempt to commit suicide. (Beth E. Molnar et al., Psychopathology, Childhood Sexual Abuse and Other Childhood Adversities: Relative Links to Subsequent Suicidal Behaviour in the US, 31 Psychol. Med. 965, 972 (Table 3)(2001))

Perpetrators of child sexual abuse remain at risk of reoffending many years after the original abuse. “Inducing a child to have sex does not depend on any overwhelming physical or sexual prowess but rather on verbal manipulation – an ability that, of course, does not recede with normal aging.” (Robert Dickey et al., Age as a Differential Characteristic of Rapists, Pedophiles, and Sexual Sadists, 28 J. Sex & Martial Therapy 211, 213 (2002). Unlike most violent offenders, child molesters do not “age out” of criminality.

Sex Offender bill makes it out of the Assembly Public Safety Committee

Assembly bill 1791, authored by Assemblyman Rudy Bermudez (D), made it out of the Assembly Public Safety Committee yesterday by a vote of 4-2.

Current law prevents registered sex offenders on parole from residing within 1/4 mile of any school K-8.

AB 1791 "prohibits an inmate released on parole who has been convicted of a lewd or lascivious act upon a child who is 14 or 15 years of age from being placed or residing for the duration of his or her parole within one-quarter mile of any public or private school containing Grades 9-12, inclusive."

Well that's a bit picky but it's better than nothing. Keep in mind Jessica's Law will be much more protective of all school children.

Ex-coach sentenced to 10 years for luring boy for sex

VIRGINIA BEACH — A former coach at a Suffolk prep school was sentenced to 10 years in prison Monday for trying to meet an underage boy for sex after a police Internet sting.

Kenneth W. Crowder, 54, was led back into custody after being sentenced by Circuit Judge Patricia L. West. He already is serving a one-year sentence for possession of child pornography in Suffolk.

West said Crowder’s crimes were especially frightening because of his history of working closely with boys as a coach at Nansemond-Suffolk Academy. “I think the community should be terrified of what you might do,” West told Crowder.

He pleaded guilty last year to two sex crimes in Virginia Beach: attempted indecent liberties and using a communication device to procure minors.

Chalk up another bust to the folks over at Perverted Justice, good job.

During sentencing Internet Pervert Ken Crownder asked the judge if he could get 'treatment' instead of going to prison. Judge Patricia West said no way and "I think the risk is too great".

It is refreshing to see a judge who gets it. Thank you Judge West.

Now let's hope Judge Bernard Schwartz, who is presiding over the cases of the perverts busted here in Riverside, gets it too. Judge Schwartz has some recent legal problems of his own, I hope this does not give him cause to go easy on the Riverside 50.

Neighborhood near San Diego shocked to find 5 sex offenders living next door

"I don't understand how individuals like that can be in the community and people next door have no way of knowing unless they go out of their way to find out," said David, a local resident. David doesn't understand why people in the neighborhood were never told about the sex offenders in the house.

"Desperate Housewives" star says she was molested as a child

Teri Hatcher, one of the stars of ABC's "Desperate Housewives," says in the upcoming issue of Vanity Fair that her uncle sexually molested her 35 years ago.

The 41-year-old actress says she learned in 2002 that a 14-year-old victim of her uncle had committed suicide. Concerned that he would escape charges of molestation, Hatcher approached the Santa Clara County prosecutors in California.

"This is something I've tried to hide my whole life," Hatcher tells the magazine, which hits newsstands Friday with the actress on the cover.

"I was just blown away by this young girl's pain," she says. "I thought, boy, that's really close to being me. Any day of the week I could feel that sort of pain. I haven't tried to kill myself, but I've certainly thought about it."

After Hatcher came forward, her uncle, Richard Hayes Stone, then 64-years-old, pleaded guilty to four counts of child molestation in the case of the 14-year-old victim and received 14 years in prison.

Chuck Gillingham, the Santa Clara County deputy district attorney in California, said, "Without Teri, this case would have been dismissed."

State Prison Reform Hopes in Jeopardy

The recent resignation of the corrections chief raises doubts about the governor's commitment to overhaul the system.

SACRAMENTO — When California's chief of corrections quit in frustration a week ago, a provocative question was left hovering in the air: Can anyone fix the state's dysfunctional prisons?

Will anyone be allowed to?

Reformers were giddy when Gov. Arnold Schwarzenegger vowed shortly after his 2003 election that he would demand "action, action, action" until the mess in his Department of Corrections was cleaned up. Overcrowding had packed penitentiaries to twice their intended capacity, increasing violence, straining staff and sending costs spiraling out of control.

Inmate medical care had become so poor that a federal receiver was eventually put in charge. And more than half of all convicts released were back in prison within two years.

To champion his agenda, Schwarzenegger picked Roderick Q. Hickman, a former prison guard and warden, as corrections secretary. Though Hickman described himself as a "hook 'em and book 'em guy," he said he believed true public safety was impossible if the state did not do a better job preparing inmates for success on the outside.

For the first time in decades, advocates of reform felt real change was within reach. A popular governor — a Republican! — was singing their tune.

But that optimism has dimmed, and inside the department — now called Corrections and Rehabilitation — employees exhausted by long hours devoted to charting a new course wonder if their efforts will amount to naught.

Explaining his resignation in an interview with The Times, Hickman said he faced dwindling support in the Legislature and governor's office for the changes he had launched. California's "political environment and the power of special interests," he said, "work against efforts to bring about lasting reform."

Day to day, Hickman was handcuffed by the power of the correctional officers union, whose labor contract gives its leaders a say in virtually every change that affects the workplace. The union, whose leaders lambasted Hickman from the start, also is a powerful player in the Legislature, capable of killing reform bills.

Wanted: Michael Shane Sadler for alleged sexual assault

In January / 2006, the La Quinta Police Department received a call of sexual abuse of a minor. In the subsequent investigation, two 13-year-old females gave accounts of being sexually assaulted over a period of five months by Michael Sadler. Sadler is known to the victims and allegedly coerced them into participating in sexual acts with him.

The suspect, Michael Sadler is a 30-year-old Caucasian male adult. He is six feet tall and weighs approximately 175 pounds. He has short, brown hair and brown eyes. Sadler is possibly driving a new charcoal gray, Nissan Titan with paper plates.

A warrant has been issued for his arrest and his whereabouts are currently unknown.

Kids catch Internet Pervert by accident

Well this is an odd story.

5 teenage boys created a MySpace account of a non existent 15 year old girl. They did it to try to cheer up their buddy who had just broken up with his gal.

Well it did not take long until they were hit on by an older guy. According to Fontana police, 48 year old Mike Ramos agreed to meet what he thought was the 15 year old girl at a park in Fontana. Police were waiting for him and according to them, Ramos said he intended to have sex with the 15 year old.

Unbelievable but true, these perverts are really persistent.

Another rapist is moved into Harriet Cooks Sex Offender Clown House

This one looks like a real winner.

His name is Jerry Walter Hampton.

Back in the late 80's he served just 3 years of an 8 year sentence for rape.

Hampton has been in and out of trouble ever since.

His most recent problems include a charge of public intoxication in April of 2003. He got 3 years probation for that.

Then just a year later, in March of 2004, he was charged with penal code 314.1, indecent exposure, a felony. That ended up being reduced to a misdemeanor. Again he got 3 years probation, even though he was still on probation for the public intoxiation a year prior to that. There was another victim in this case and he has been ordered to stay away from her.

His most recent stays in prison include Atascadero and the California Men’s Colony near San Luis Obispo.

Last year he had a charge of failing to register as a sex offender. He was paroled out of prison in July of 2005 to Moreno Valley unit 2. Remember, parole supervisor Lisa Abma is unit 3, so don't call her any names and hurt her delicate feelings.

With the surprise resignation of the state's corrections secretary last week, Gov. Arnold Schwarzenegger has a chance to repair what some experts say is one of his worst failures, the growing problems of the desperately overburdened prison system.

But corrections experts have some sobering news for the governor -- the job, most agree, may be impossible to perform without drastic changes.

In interviews, a number of experts generally agreed that the new secretary ought to be a high-profile personality from outside the department with great political clout and that the governor must make a far stronger, personal commitment to see parole reforms through. They also said that sentencing laws should be changed and that the state must pour more money into drug rehabilitation.

But even if those changes were made, few of the experts were optimistic. Most said the atmosphere in the state Department of Corrections and Rehabilitation is so poisoned by infighting and paralysis that few would want the job.

Joan Petersilia, a visiting law professor at Stanford University who worked two years as a special adviser to the outgoing secretary, Roderick Hickman, said one of her assignments was trying to recruit experts for high-level jobs. She always failed, she said, not because of the depth of the problems, but because the candidates complained that the department was too politicized.

"What I kept hearing was they always questioned the sincerity of the people at the top," said Petersilia. "They just didn't feel this was a very professionally run organization. They said it was too political, and you were too much at risk of being replaced if you upset anybody."

The Schwarzenegger administration inherited a prison system suffering an array of problems that, most agree, the governor has largely failed to correct or has made worse.

Parole pissing off the wrong people

Two more sex-offender parolees, reportedly without ties to the Antelope Valley, have been placed locally, drawing consternation from Valley officials.

Edgardo Rene Carrillo, 34, was moved into a Palmdale motel last month, while Anthony Moreno, 35, was placed in a rural eastside location Feb. 15, records show.

Both were convicted of sex crimes against children.

"Once again, Corrections is messing with us, and we need to get this (Carrillo) guy out," said Sharon Runner, R-Lancaster. "It seems like this is a weekly issue, and we need to make sure they're honoring the agreement they have."

The Riverside County Sheriff's Department only leaves their press releases up on the net for a limited time. They have since removed the press release about the Riverside sting however I, your fearless blogger, anticipated this and saved the information to a top secret secure location.

If you remember the original photos you would not be out of line to say the person taking the pictures was photographically challenged as most were out of focus. I have since cleaned them up and posted them below.

Four of the perverts caught are registered sex offenders. I added links to their Megan's Law pages.

Most of these perverts are out on bail. According to Perverted Justice, two of the Riverside perverts made contact with the Perverted Justice decoy during their Laguna Beach sting operation. Sad but true, these creeps just don't get it.

He's been blasted by talk radio hosts and TV pundits. These days Assemblyman Mark Leno is a prime target of the right. Critics say he's soft on criminals. Some supporters say he's singled out because he's gay.

Assembly Speaker Fabian Núñez angrily approached Assemblyman Todd Spitzer near the floor of the Assembly recently.

"This is bull----," Núñez said, waving a written commentary in which Spitzer characterized Assemblyman Mark Leno as an "ultraliberal" who leads a "pro-criminal" majority.

Spitzer blasted Democrats as "soft on crime" and accused Leno's Public Safety Committee of consistently putting "the rights of career criminals over those of law-abiding citizens."

"This is bull----," Núñez repeated, then stormed away from the Orange County Republican.

Leno, 54, has been grilled on the Internet, blasted on conservative talk radio and criticized on political TV shows ranging from "The O'Reilly Factor" to "Hannity & Colmes."

Supporters say the attacks against Leno are politics at their ugliest.

"The fact is, he's being picked on because he's a gay member of the Legislature," Núñez said last week. "That's just the bottom line. ... They won't come out and say it here, but on AM radio stations, they're being pretty clear about that."

The firestorm over the San Francisco Democrat, one of six openly gay California legislators, is setting the stage for a bitter election year in which Republicans will portray themselves as fighters for public safety and family values, analysts say.

"They want to use this as a symbol," Larry Gerston, a San Jose State University political science professor, said of the flap over Leno.

The partisan mudslinging began with a floor battle over dueling proposals - by Leno and the GOP - to get tougher on sex offenders.

The crackdown on child sexual abuse is being driven by a GOP signature-gathering drive to qualify a proposed ballot measure, known as "Jessica's Law," for the November ballot.

Leno is a Republican target, in part, because he helped kill GOP legislation identical to "Jessica's Law" and crafted the alternative that Republicans claim is much weaker.

But GOP dissatisfaction with Leno's leadership on the Public Safety Committee has been building for months, culminating last year with Republicans distributing to reporters a list of "tough on crime" bills that he helped kill.

"After years and years, and bill after bill, of Republican public safety bills being systematically relegated to the round file, Assembly Republicans are drawing a line in the sand," Spitzer said in his commentary.

Besides Leno, the six-member Public Safety Committee includes three other Democrats, including liberals Mervyn Dymally of Compton and Jackie Goldberg of Los Angeles.

Spitzer said the panel was handpicked to do Núñez's bidding, adding, "The speaker is systematically using (it) to kill pro-public safety bills."

Ex-teacher admits abuse guilt

He is sentenced to 16 months. Victim was in his class at a Westminster middle school; they later had sexual relationship.

SANTA ANA – A former middle school teacher in Westminster was sentenced Friday to 16 months in prison after pleading guilty to molesting a boy he taught in his eighth-grade class.

The case of Daniel Havlik, 42, is unusual in that the victim moved in with Havlik after he turned 18 and continued the relationship for four more years, said Havlik's defense attorney, Marlin Stapleton.

The boy was in Havlik's eighth-grade class at Willis Warner Middle School in the mid-1980s. The pair developed a relationship that progressed into a long sexual relationship, Deputy District Attorney Mike Fell said.

When the victim was 22, he admitted the relationship to his therapist, who told police, Stapleton said.

How David Allyn Dokich was really caught

I can't count how many times I have been asked "How did they catch Dokich?" or "How did they know where he was?" or "Did they use the GPS to catch him?".

Allow me to preface this by saying I cannot reveal some of the methods used to catch High Risk Sex Offender David Allyn Dokich. Doing so could jeopardize future operations of local law enforcement.

When Dokich was paroled and placed into a halfway house in Mead Valley on May 5th, 2005, he had to be driven around by others as he had no vehicle of his own. That changed in late September of 2005 when Dokich got his own car, a silver Ford Taurus, and started traveling alone. The Riverside County Sheriff's Department took note of this development.

Now you would think that it would be easy to track Dokich since he had a GPS device strapped to his ankle. Well apparently access to the GPS data is controlled by parole and they don't want to share their new toy with others.

So deputies from the Perris station had to come up with another ways to determine where Dokich was going to. It was not easy but they did this in early November. Within two weeks sheriff deputies on the Violent Offender Registration Team determined Dokich was violating his parole.

So that's it, they got him, right? Wrong. You see parole violations have to be handled by the Parole Division of the California Department of Corrections and Rehabilitations. Local law enforcement can't touch him for a parole violation.

Knowing how those screwheads in parole are bound and determined to place sex offenders near children and the fact that parole does not have the best working relationship with other agencies, the decision was made to keep investigating Dokich with the goal of getting so much evidence that parole could not refuse to violate him.

After 2 months of investigating Dokich and his numerous parole violations it was decided the time was right to inform parole. Calls went in to District Administrator Doris Mahlum but they were not returned.

Finally, on January 4th, someone else from the Moreno Valley parole office was sent to the Perris Sheriff's station to see the evidence the VORT team had gathered. It was non other than our favorite Parole Agent III, Lisa Abma.

Yep, the same Lisa Abma that went berserk on the side of the road claiming she had nothing to do with Dokich. The same Lisa Abma that tried to serve phony Cease and Desist orders on protesters. The same Lisa Abma that took me, your fearless blogger, to court.

When presented with the overwhelming evidence gathered by the VORT team the decision was made that Dokich had indeed violated his parole by frequently going to a place that served alcohol and where children congregated.

The deputies were thrilled and wanted to pick up Dokich right away but he was not at Harriet Cooks clown house. No problem, he has a GPS device strapped to him, just use that to figure out where he is.

No can do. For some reason parole was not able to tell the deputies where Dokich was. They ended up having to call him on the phone and ask him to come in.

Well there you have it. It took extrodanary measures by the Riverside County Sheriff's Department to keep an eye on this predator and eventually get him back behind bars.

Questions need to be asked about parole:

Where were they when Dokich was violating the conditions of his parole by hanging out where alchol was served and children played for months?
Did parole know this and choose to ignore it?
If they did not know where Dokich was going, why didn't they? They have the GPS device.
And why won't parole allow other law enforcement agencies access to the GPS data?

Finally, below is a video of a small portion of our surveillance. I can tell you stake outs and surveillance is really, really boring.

The only reason I am making this video available is to demonstrate to the child predators out there that law enforcement is not the only one keeping an eye on you.

A Profile of the Child Molester

Pedophiles possess no tidy criminal profile. They come from all walks of life. Some are married, some single; some professional, some blue-collar; some young, some retired. Some prefer boys, and some prefer girls. Some are attracted to young children, others to older children. In short, pedophilia, or sexual attraction to children by an adult, is a sickness that does not discriminate by race, class, or age. It knows no bounds, and afflicts people in every segment of society.

Most pedophiles do, however, share several characteristics. The overwhelming majority are male. Only a small percentage of women sexually abuse children, and they are usually cooperating with a male aggressor.

Few pedophiles are able to resist their powerful urges to initiate sexual contact with children. As a result, child molesters often make efforts to gain access to or authority over children. They take jobs where children are easily approached, or they actively pursue youngsters by befriending parents (particularly single parents), attending events for children, coaching children's sports, chaperoning camping trips, frequenting video arcades, or offering baby-sitting services to friends, family, and neighbors with children. Their #l lure of choice is the Affection Lure, which they have used over the ages to seduce generations of unsuspecting youngsters, in need of love and attention.

Ex-pastor gets 15 to life for molesting two girls

Victim's brother found images on defendant's camera phone

Were it not for the suspicions of a protective brother, former pastor Donald Domelle might still be molesting a teenage girl, rather than making his way to prison.

Domelle, former pastor of the Baptist Temple of Salinas, was sentenced to 15 years to life in prison on Thursday for molesting two girls, one of whom left the area to escape him.

Domelle, 65, was arrested after the brother of the second victim, a developmentally delayed teenager, followed the pastor and his sister and observed Domelle taking photographs of her. The boy later checked Domelle's camera phone and found what prosecutor Gary Thelander described as pornographic digital images of his sister.

Like many in the congregation, the boy's mother was at first reluctant to believe the news, and Domelle at first denied knowledge of the photos. He later admitted that he had carried on a sexual relationship with the girl when she was 14 and 15 years old, in her home, his van and in the church.

He admitted a sexual relationship with another teenage girl in the congregation, whom he started molesting when she was 6.

Norco extends moratorium on parolee homes

Back on Jan. 18th of this year, Norco enacted an urgency ordinance to stop new halfway homes / group homes / sober living homes (they have lots of names for these things) not licensed by the state from opening in the city.

Last night the Norco city council decided to extend the 45 day moratorium an additional 10 months and 15 days.

Here is what the coucil had to say last night:

Due to concerns regarding the potential for location of parolee homes in the City of Norco, an urgency ordinance was adopted by the City Council to implement a 45-day moratorium on the approval and/or commencement of operation of any non-state licensed parolee homes. The urgency ordinance was adopted on January 18, 2006 to allow the City to determine if specific regulations for this type of facility are needed. It has been determined that it is in the best interests of the community to extend the moratorium for 10 months and 15 days to allow adequate time to develop regulations for the location of any non-state licensed parolee homes within the City. An ordinance has been prepared to allow this extension of the moratorium.

I applaud all of the good folks in Norco who stood up for themselves to stop this invastion. Great job everyone!
